PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCEPTING THEM, THEY ARE THE CONTRACTUAL RELATIONSHIP BINDING THE CUSTOMERS AND betFIRST. IT IS LEGALLY BINDING. IF CUSTOMERS DO NOT AGREE WITH THEIR PROVISIONS, THEY MUST NOT ACCEPT THEM OR USE ANY OF THE SERVICES PROVIDED BY betFIRST.

SPORTS BETTING IS A STRICTLY REGULATED ACTIVITY. MANY OF THE PROVISIONS IN THESE TERMS AND CONDITIONS ARE DERIVED FROM THE LAW. A BREACH OF THESE TERMS AND CONDITIONS MAY CONSTITUTE A BREACH OF A LEGAL PROVISION.

  1. SCOPE OF THE CONTRACT

1.1 The retail Sports Betting offers are provided via terminals which are operated under the betFIRST brand owned by SAGEVAS S.A. SAGEVAS S.A. is the holder of licenses FA116764 and FA+116764, both granted by the Belgian Gaming Commission, the supervisory body and decision-making body for games of chance under Belgian law (https://www.gamingcommission.be).

1.2 betFIRST is a member of the Belgian Association of Gaming Operators (BAGO) (https://bago.be).

1.3 These Terms and Conditions apply to the betFIRST Sports Betting available in newsagents and betshops (“F2 license holders”).

1.4 The use of games of chance including betting offers is subject to the regulations imposed by the Belgian Gaming Commission (https://www.gamingcommission.be).

1.5 Before betting, Customers must carefully read the Terms and Conditions and ensure they fully understand their content. If Customers have any doubts concerning their rights or obligations in regard to accepting these Terms and Conditions and any other applicable terms, they shall consult a lawyer.

 

1.6 The Terms and Conditions include the Betting Rules, accepting the Terms and Conditions, Customers confirm that they have read and understood them and agree to abide by them.

1.7 The newsagents and betting shops managers operate betFIRST terminals and bets for the account of betFIRST.

  1. DEFINITIONS

- Bet means game of chance on which the Customer wagers a certain amount of money, and which produces a gain or a loss, which does not depend on an act performed by the Customer but on the verification of an uncertain outcome which occurs without the intervention of the Customers. The betting process is therefore characterised by the attribution of a gain won by the Customers’ and the latters’ acceptance that they risk having to finance this gain.

- betFIRST means SAGEVAS S.A. and any entities to which it delegates part or all of the Sports Betting Services.

- betFIRST Software means the digital system installed in order to allow the Customers to take Bets anonymously on betFIRST Terminals and betFIRST PC. This system allows the F2 license holder to use standardised procedures and facilitates the collection of information necessary for management of the bets and reporting with the BGC.

- betFIRST PC means the digital equipment installed by betFIRST, for the use of the F2 license holder, which facilitates the use of the betFIRST system.

- betFIRST Terminal means the automated digital equipment installed by betFIRST for the use of the F2 license holder, which comprises an interactive betting terminal with touch-screen facility, with which the Customers can place Bets autonomously by using the betFIRST system.

- Bet Registration means the introduction of Bets into the betFIRST system via the betFIRST PC or the betFIRST terminal. This registration is a reference by which to determine the Bets actually established by the Customers. For each Registration, an Identifier (herein referred to as “Identifier”) in the form of a series of numbers and/or letters is generated.

- Betting Rules means the rules which specifically govern the terms and conditions of the bets organised by betFIRST.

- Betshops means the points of sale which betting product are sold as a main activity.

- BGC means the Belgian Gaming Commission, the supervisory body and decision-making body for games of chance under Belgian law.

- Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by European Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

- Customer(s) means eligible persons of minimum 21 years old or over who reside in Belgium who use the Services and have a contractual relationship with betFIRST.

- Customer Service Team means betFIRST customer service support team which can be contacted in English at support@betfirst.be, in Dutch at support.nl@betfirst.be, in French at info@betfirst.be and in Turkish at destek@betfirst.be.

- Expired Win means Win related to a winning registration form that has not been used during its validity period.

- F2 license holder(s) means a company or a manager who manages a point of sale, the license holder can be either (i) a newsagent whose principal activity is bookselling and who sell betting product as an ancillary activity or (ii) a betshop whose main activity is to sell betting product. The term applies to a number of individuals and groups - the company, its legal representative, the salesperson and his/her employees.

- Force Majeure means an event or a situation beyond the reasonable control of the party concerned, which prevents it from performing its contractual obligation on a temporary or permanent basis.

- GDPR means the General Data Protection Regulation, i.e. the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th of April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

- Newsagent means the point of sale which sells on an ancillary basis betting products.

- Personal data means any information relating to an identified or identifiable natural person (“Data Subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

- Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

- Registration Paper means the document printed following registration by the Identifier and describing the Bet(s) placed. The registration paper is given to the Customers – it constitutes the proof of contract between betFIRST and the Customers. However, in the event of a discrepancy in Bet information described on Registering and written on the Registration Paper, the information given on registering will prevail.

- SAGEVAS S.A. means the public limited company incorporated and registered under the laws of Belgium, with company number 0832.457.166, with registered office at Avenue Louise 209A, 1050 Brussels holder of the F1 license number FA116764 to offer betting in class IV gaming establishments and additional F1+ license number FA+116764 to operate betting via information society tools on the Website and the App, both granted by the BGC.

- Services means the Sports Betting services offered by betFIRST in the newsagent and betshops.

- Sports Betting means the Sports Betting services available on the betFIRST PC and Terminals.

- Validation of the win means the introduction of the Registration Paper in the betFIRST system with a view to determining any eventual Wins. This validation constitutes a reconciliation between the Identifier and the description of the Wins and or the Bets.

- Wager means any sum of money paid by the Customers that corresponds to the amount in bet(s) placed.

- Win means the sum of money the Customers has a right to access when, at the time the event has taken place, their Bet is winning.

- Winning Ticket means the document which is printed following validation, claimed by the Identifier, and which describes the Wins and or Bets placed. In the event of any discrepancy in information between the Wins described and the Validation of the Winning Ticket, the Validation information will prevail.

  1. INTERPRETATION, SCOPE AND OPPOSABILITY TO THIRD PARTIES

3.1 Future rules. Updated Terms and Conditions supersede and cancel all previous versions. They are applicable to from the day that they are posted on the betFIRST Terminals et betFIRST PC. Unless stated otherwise, references to the present Terms and Conditions include all references to any future eventual amendments to the Terms and Conditions.

 

3.2 Amendment(s). betFIRST reserves the right to amend or update any part of the Terms and Conditions. Notice of modification will be posted. betFIRST therefore recommends that the Customers consult the text of the Terms and Conditions regularly. If the Customers do not agree with the changes made by betFIRST, they shall not bet.

3.3 Special Conditions. In the case of Sports Betting offers which are subject to special conditions, these will take precedence over the Terms and Conditions, unless stated otherwise.

3.4 Nullity. If one of the provisions of the present Terms and Conditions is declared invalid, unlawful, void or inapplicable under Belgian law, this will not affect the validity of the remaining provisions nor the validity of the part of the affected provision that is not considered invalid, unlawful, void or inapplicable. In the event that such an invalid, unlawful, void or inapplicable provision would affect the nature of the Terms and Conditions, it must be considered as having been replaced by a valid replacement rule which reflects as close as possible the condition laid out by the former one.

3.5 No waiver. By not exercising or enforcing the rules and rights expressed in the Terms and Conditions, betFIRST does not waive, denounce or abandon these rights, unless it is recorded in writing.

3.6 Force majeure. betFIRST is not responsible for any failure to execute the Terms and Conditions due to unforeseen circumstances or Force Majeure.

3.7 Warnings. Although every effort is made to ensure that information regarding an event is correct, Customers shall use the information provided by betFIRST as a guide only. For the purposes of live betting, there is always a possibility of delay to the transmission of information and therefore betFIRST recommends consulting other resources if Customers are in any doubt regarding the current information shown. betFIRST does not have liability over the information about the Sports Betting events.

3.8 No Warranties. betFIRST offers Sports Betting on an “as is” basis and does not always guarantee full and uninterrupted operating conditions. betFIRST does not make any other warranties, express or implied.

3.9 Change in Services. betFIRST reserves the right, without the obligation to notify the Customers, to modify, suspend or withdraw the use of all or certain Services, temporarily or indefinitely, at any point, without explanation or compensation for any losses Customers may suffer as a result thereof.

3.10 Precedence of the French version. In the event of discrepancies between the French, Dutch, English and Turkish versions of the Terms and Conditions, the French version shall take precedence.

3.11 Applicable law and jurisdiction. The place of the contract is Belgium. Belgian laws, to the exclusion of private international law, apply to all disputes relating these Terms and Conditions. Any dispute shall be submitted exclusively to the courts of Liège.

 

  1. ACCESS, PROCESSING AND MANAGEMENT OF CUSTOMERS’ PERSONAL DATA

 

4.1 Principles. betFIRST is the controller of your personal data and is committed to protecting your personal data.

 

betFIRST complies with the EU General Data Protection Regulation (GDPR) and Belgian data protection laws, specifically the Law of 30 July 2018 on the protection of individuals regarding the processing of personal data.

 

betFIRST recognizes the importance of protecting information assets, preventing unauthorized access, and securing personal data. We use monitoring systems, secure payment technologies to ensure data protection in our newsagents and betshops. Despite the care we take to secure our systems, errors or vulnerabilities may happen. In case you see an error or a vulnerability, please inform us thereof so that we can remediate. You can report a security issue to the point of sale or to our customer support team.

 

 4.2 What data do we process?

  • Personal identification data: civil status, last name(s) and first name(s), date of birth, address.
  • Electronic identification data: phone number.
  • Data related to identity documents: passport, Identity card, Nationality, National register number.
  • Image recordings: images (photos), video recordings.
  • Financial data: bank account number, bank name, Account holder’s name, transaction information (bank transfers).
  • Data related to the person’s gaming activities: types of bets placed, winnings.

We collect data when your wagers are above 1,000 euros per day, when your winnings are above 2,000 euros, when you request support, when we verify your identity for age restrictions or EPIS control, through CCTV monitoring, etc.

 

4.3 Why do we process your personal data?

  • Business Operations and Service Delivery: we process personal data to provide you with payments or winnings.
  • Contractual Obligations: to verify age.
  • Compliance with Legal and Regulatory Obligations: we comply with the BGC and anti-money laundering laws by verifying identities for responsible gaming and recording transactions and reporting suspicious activity to authorities.

4.4 On what legal bases do we process your data?

 

We process your personal data based on different legal basis defined by the GDPR:

  • Execution of a contract (GDPR, art. 6.1.(b)): collecting identification details for handling transactions payment.
  • Legal obligation (GDPR, art. 6.1. c)): compliance with gambling regulations, including storing certain players' personal and transaction data. betFIRST must report player data to authorities such as the Belgian Gaming Commission (BGC), tax authorities, or other government bodies upon request, without informing the player. It must also implement responsible gaming policies for player protection.

Additionally, betFIRST is required to comply with Anti-Money Laundering (AML) laws, ensuring identity verification, monitoring suspicious transactions, and reporting potential fraud, money laundering, or terrorism without notifying the player.

 

Finally, betFIRST ensures financial, accounting, administrative, and tax compliance, maintaining accurate records and collaborating with relevant authorities.

 

The main regulations are the following:

 

  • Any other relevant guidance that the BGC issues in addition to the aforementioned laws and regulations.

 

  • Legitimate Interest (GDPR, art. 6.1.(f)) : Fraud detection, security, controls, watching, defense in justice, collaboration with authorities,...

4.5. Where do we store and process your personal data? All personal data is stored securely within the European Union. Transfers outside the EU are only done with appropriate safeguards (e.g., Standard Contractual Clauses).

 

4.6 How long do we keep your personal data? betFIRST retains personal data the necessary period to provide you our services and in compliance with applicable laws.

 

Betting and transaction data are retained for up to 10 years, in compliance with anti-money laundering laws. Security footage (CCTV) are retained for 30 days unless required for legal purposes.

 

Other data may be stored for a maximum period of ten years after the contractual relationship, except for the personal data that we have to keep for a longer period based on specific legislation or in case of an ongoing dispute for which the personal data is still necessary.

 

4.7 Security: technical and organisational measures. betFIRST ensures the security of personal data through advanced technical and organizational measures, protecting it from unauthorized access, loss, or misuse. Employees follow strict security policies, undergo training, and sign confidentiality agreements.

 

Financial transactions are safeguarded with encryption, and a dedicated team continuously monitors system security. While betFIRST takes extensive precautions, it is not liable for third-party misuse of personal data.

 

4.8 Your Rights as a Data Subject. Under GDPR, you have the:

 

  • Right to access. You can ask for accessing your data and inspect it.
  • Right to rectification. You have the right to obtain rectification (correction) of your incorrect personal data, as well as to complete incomplete personal data.
  • Right of erasure or limitation. You have the right to request us to erase or limit the processing of your personal data in the circumstances and under the conditions laid down by the General Data Protection Regulation. We shall refuse the deletion or restriction of any personal data which is necessary for us to fulfil a legal obligation, the performance of the contract or our legitimate interest, and this for as long as these data are necessary for the purposes for which they were collected.
  • Right of objection. You have the right to object to the processing of your personal data for serious and legitimate reasons. Please note, however, that you cannot object to the processing of personal data which is necessary for us to fulfil a legal obligation, the performance of the contract or our legitimate interest, and this for as long as these data are necessary for the purposes for which they were collected.
  • Right of withdrawal of consent. If the processing of personal data is based on prior consent, you have the right to revoke this consent. These personal data will then only be processed if we have another legal basis for doing so.

You can exercise these rights by contacting dpo@betfirstgroup.com. We will act on the request within 30 days. However, in certain circumstances, such as in the case of a complex request or an overload of requests, we will not be able to process such data within this initial 30-day period, but we will inform you of the reasons and propose a period of not more than 90 days.

  1. TERMS OF USE

5.1 GENERAL RULES FOR THE USE OF SERVICES

5.1.1 Freedom to choose its Customers. betFIRST has the right to freely choose who to accept as Customers, without obligation to provide justification as long as this refusal is not based on unlawful discriminatory grounds. Same apply for the license F2 holders or their representatives.

5.1.2 Conditions to be a Customer. Customers warrant and represent that:

  • they are at least 21 years old;
  • they are not banned from playing by the Belgian Gaming Commission;
  • they are not employed by betFIRST, by betFIRST’s distributors, wholesalers, subsidiaries, agents or retailers and are not immediate family members of one of the mentioned;
  • if they are a professional player in a sport, competition or league in which betFIRST offers Bets, they will not bet on any event where they are either participating in or have significant inside knowledge of;
  • they have the legal capacity to enter into a gaming agreement;
  • they are neither compulsive players nor have gambling problems, nor (whether voluntarily or not) registered on any database of excluded gamblers;
  • they will play for personal leisure and under no circumstances for professional use;
  • they do not use and wager money obtained from criminal or illegal activities;
  • they do not engage in criminal activities involving, directly or indirectly, the Services;
  • they provide true, complete, accurate personal information where identification is due;
  • they only use debit cards (no credit) and never business (professional) cards;
  • they understand the legal and regulatory framework and also make sure that they are fully aware of the Betting Rules;
  • they have an obligation to place their bet(s) individually (without anyone else);
  • they cannot act as part of a cartel;
  • the money that they wager may be lost and that this is their responsibility;
  • the series of events on which they bet must be random, which means that the Customers cannot place any Bet on any events whose random nature would be altered by the fact of the Customers being conscious of certain facts or of his impact, either direct or indirect, on such a series of events.

5.1.3 Cartel. betFIRST and the F2 license holder retain the right to refuse identical Bets placed by one person (as part of a cartel).

5.1.4 Technical issue. In case of Software error or technical fault which is or can be proved by betFIRST on their systems or those provided to them, Bets will be cancelled. Customers will be reimbursed the total sum of the amount placed on the affected Bet. betFIRST accepts no responsibility for such a fault in either the Software.

5.1.5 Fault detection. If the Customers detect a fault with betFIRST Software, they must inform betFIRST as soon as the fault is discovered by contacting the Customer Service Team.

5.1.6 EPIS control. Betshops shall control the identity of the Customers at the entrance of the betshop to ensure that Customers are not registered on the EPIS list which contains the banned players. As of 1st June 2026, EPIS control will take place also at newsagents, a verification of the identity will be made directly on terminals placed at newsagents’ shops.

5.2. CUSTOMERS’ BEHAVIOUR

5.2.1 Contact and politeness. Customers are informed that F2 license holders may refuse to let them bet if the basic rules of politeness and courtesy are not complied with.

5.2.2 Rules. When contacting betFIRST or a point of sale, the Customers shall not make statements or transmit content that are sexually explicit or grossly offensive, uses derogatory terms, distribute/spread or facilitates antisocial behaviour, hateful, racist, anti-Semitic, xenophobic, homophobic or defamatory comments, encourages or facilitates any illegal activities; harasses, threatens or causes distress or inconvenience to other Customers; messages stating positions or opinions of a political or religious nature and abusive, excessive and displaced messages, which try to mislead other Customers about Betting Rules, influences other Customers’ actions through intimidation or abuse; disrupts the normal flow of dialogue, make statements that are abusive, defamatory or harassing.

 

  1. ANTI-MONEY LAUNDERING

6.1 Prohibition. It is strictly prohibited to use the Software for the purposes of money laundering or financing terrorism.

6.2 Identification. Copy of the personal identification documents shall be taken for:

  • any daily total sum of bets over €1,000 in betshops;
  • any Winning Ticket(s) paid out of an amount higher than €2,000 whether in betshops or newsagents;
  • any Winning Ticket paid out of an amount higher than €3,000, the F2 license holder shall also take a copy of the bank account information of the Customers and payment shall be made by wire transfer on a personal bank account of the Customers who won.

6.3 Daily total of Bets over €1,000. The identification is shared with the BGC on a daily basis.

6.4 Winning Tickets paid out over €2,000. Anti-money laundering documents shall be filled in and signed by the Customers. Those documents may be provided to the BGC, the police or any authority which would ask for them.

6.5 betFIRST rights. Where betFIRST or the F2 license holder suspects the use of the betFIRST Terminals for money laundering purposes, betFIRST may report to the competent authorities. The same applies in the event of suspected or alleged fraud of any kind.

  1. PLACING OF BET(S)

7.1 F2 license holders respect the legal and regulatory conditions - for example, they can request a form of ID from the Customers, in order to verify their age.

7.2 F2 license holders can refuse to take a Bet, for example when they believe Customers to be acting together in collusion with others and placing a bet from a single account belonging to one person, in an attempt to bypass the rules.

7.3 Time to place Bets. The placing of Bets can only be effectuated when authorized:

  • in a betshop, during the point of sales opening hours;
  • in newsagent, in accordance with the applicable regulation;

betFIRST can cancel the Bet(s) if the time of bet is not complied with.

7.4 F2 license holders manage the bets using a digitized system provided by a contractor of betFIRST (the “betFIRST System”).

  1. MANAGEMENT OF THE BETS
  • Bet taking involves registering information relating to the Bet in the betFIRST System, either by the F2 license holder or the Customer via an interactive betting terminal. The registration of Bet(s) is associated with an Identifier according to a series of number and or letters. The date and time of Bet(s) taking is determined by the betFIRST System’s clock.
  • The taking of Bets is always preceded by the payment of the wager by the Customers.
  • The minimum wager amount to be registered depends on the terminals.
  • The Registration Paper is printed following the taking of Bet(s) and is given back to the Customer by way of proof. The Customer will only be able to receive payment from Winnings on return of the Registration Paper.
  • The Registration Paper mentions the Identifier and describes the Bet(s).
  • The Registration Paper contains the F2 license holder details, having taken the Bet(s), and any potential winnings can only be paid out by the F2 license holder.
  • On receiving the Registration Paper, the Customers accept the Betting Rules.
  • The Registration Paper is valid for thirty (30) days following the closing of the Bet. Once expired, the Registration Paper can no longer be used to receive Winnings.
  • The Customer cannot cancel their Bet. The Bet cannot be subject to cancellation – a message requesting confirmation of Validation of the Bet will be presented before the Bet is registered, meaning that the Customer can cancel it before registering.
  • Once the Bet has been closed, the Customer must hand in their Registration Paper to the F2 license holder, who will validate it in the betFIRST system that determines any potential Winnings.
  • In the event of any discrepancy between the information registered in the betFIRST System and the Registration Paper, the information registered in the betFIRST System will prevail.
  • A validation ticket will be printed from the betFIRST system stating the Winnings, the date of validation and the date that the Winnings were paid out.
  • The maximum total possible win (after deduction of the stake) for a given Customer per betslip is €100.000. The total aggregated winnings from all identical Bets placed will be limited to the maximum winnings restriction of €100,000. Similar combination Bets where the Customers have used the same or similar elements/pattern more than once may have their total aggregated winnings for all Bets limited to €100,000.
  • betFIRST will refuse to take Bets, and will make invalid any Bets, from Customer whose aim is to increase the maximum authorised Winning amount.
  • In the event that any type of fraudulent activity has occurred, betFIRST retains the right to pay out only the amount that has been won by a single player and/or to cancel the Bet and return the stakes.

Wagering. In newsagent shops, the maximum betting per day is set at €200 per Customer per day. In betshops there is no limit but the identification of the Customers is requested as of €1,000.

  1. CANCELLATION OF THE BETS

The following Bets can be cancelled either by the F2 License Holder or by betFIRST, either on their own initiative, or at the request of the Customer:

  • Bets that do not conform to the legal and regulatory conditions or to the Betting Rules;
  • all Bets containing an error which significantly modifies the expected result, whether by a technical fault (electronic malfunction...) or by human error (a coding error...), whether this error is to the Customer’s advantage or disadvantage, which include incorrect odds, incorrect results, Bets incorrectly placed, an invalidated registration paper or a badly printed validation slip;
  • all Bets on events whose random nature has been altered by the fact of the general public (public) or an individual (the Customers) being aware of them, or the results being made accessible early (like non-live bets, placed after the beginning of the event in question), or by occurrences which have an impact on the course of an event;
  • all Bets on events whose random nature is altered, either directly or indirectly, by a Customer, or by a Customer’s participation as part of a collective effort to profit from an influence on the event concerned, without prejudice to requests of loss and interest of fraud in respect of the Betting Rules;
  • ambiguous Bets, i.e. bets whose interpretation is in question;
  • the winner of an event subject to a Bet is in every case the person declared as winner on the day of the event before midnight (local time of event). This also applies to long-term Bets. Modifications in classification or results published - made for any reason - after this time will have no impact on the paying of Winnings. More specifically, modifications of results made due to disciplinary methods imposed by law or by legal proceedings or by a sporting authority (for example, in the case of doping, disqualification, suspected fraud, corruption or another issue), are not taken into account, and will have no impact on the matches concerned, whether placed as a single Bet or as part of a combination of Bets placed on the match(es) concerned;
  • in the event of suspected manipulation or fraudulent activity, betFIRST reserves the right to cancel the Bets in question (even afterwards), the legal consequence of which is the taking back of the wager already paid for closed, contested Bets, and to exclude the Customers from all future Bets. The Customer will be particularly under suspicion of manipulation or fraud in the following cases:
  • Betting on events with an unusual result;
  • Betting with abnormally high payment results;
  • Combo bets on unusual matches/leagues;
  • Bets spread out over time with the same combination or combinations that have been significantly modified;
  • Bets which indicate a concentration of bets and which are linked with regards to time and content;
  • Combination Bets where the Customers have used the same or similar elements more than once may be refused by betFIRST. The combination of these elements with other elements in order to conceal any fraudulent activity may be considered as one - and only one - combination. If any Customer is suspected of having placed a Bet in this way, the total winnings obtained from these Bets will be restricted to the maximum winning's limitations.

The Customers will find additional rules in the Betting Rules.

  1. LIMITATION OF RESPONSIBILITY

10.1 Responsibility. betFIRST assumes the responsibility as the organiser of Bets while the F2 license holder assumes responsibility as the operator of the sale of the Bets on behalf of betFIRST. Each party accepts full responsibility if the damage is caused by intentional fault or gross negligence on their part.

10.2 Force majeure. betFIRST and the F2 license holder take no responsibility for situations that are a force majeure event, so events out of their control, for example, any system failures, strikes, natural disasters, acts of vandalism acts or decisions taken by public powers.

10.3 Information on Bets. Information provided by betFIRST about events constitutes a voluntary service on the part of betFIRST, independent of Bets. The Customer is advised to consult several sources of information in order to have a good understanding of the events on which they are betting. Any potentially false or incomplete information from betFIRST cannot constitute the cancellation of Bets.

10.4 No recourse against Auxiliary Persons. The Customers expressly acknowledge and agree that betFIRST may engage auxiliary persons. betFIRST seek to protect certain categories of auxiliary persons against direct claims under Article 6.3 of the Belgian Civil Code or under any other applicable law. These categories include, in particular, directors, appointees including employees, and independent service providers (including amongst others commercial agents and managers but excluding third parties engaged on an occasional or project basis, such as subcontractors or freelancers) (hereinafter: the “Auxiliary Persons”).

The Customers expressly undertake not to directly pursue the Auxiliary Persons in the event of errors within the meaning of Article 6.6 of the Civil Code or any other applicable law by the Auxiliary Persons. Instead, the Customers shall exclusively direct any claim for damages to betFIRST. The Customers hereby expressly waive their direct claim against the aforementioned Auxiliary Persons. This waiver does not apply in cases of fraud, deceit, and/or willful misconduct by the Auxiliary Persons, or if the breach also constitutes a criminal offense.

 

  1. INDEMNIFICATION

Customers will indemnify, compensate and hold harmless all employees, directors, contractors of betFIRST and its partners against all costs, damages and losses (lawyer and legal costs included) in case of legal action, complaint or request made either by a third party or the Customers as a result of the violation of the Terms and Conditions, the applicable laws and/or Betting Rules.

  1. RESPONSIBLE AND ETHICAL GAMING

12.1 Moderation. betFIRST is committed to promoting responsible gaming and minimizing the risks associated with gambling. betFIRST encourages Customers to gamble responsibly, recognizing that while gambling can be an enjoyable form of entertainment, it may also lead to psychological, social, or financial challenges.

12.2 Support. If Customers need support in managing their gambling activity, they can consult BGC pamphlets. This booklet provides tools and resources to help Customers stay in control, as well as information on gambling addiction and responsible gambling.

13.COMPLAINTS

13.1 Contact. Customers shall contact the point of sales for any request or queries about the Bets or Winning Tickets. If unsatisfied the Customer can send their complaints via letter to the registered office of SAGEVAS or to send an email to our Customer support team:

13.2 Information required. In order to deal with Customers’ complaints quickly, the Customers shall provide all relevant information about their identity as well as clear details of the reason, nature and object of the complaints as well as the identification of the betting shop or newsagent it played. betFIRST may request more information to identify the Customers.

13.3 Complaints procedure. Complaints must be made 3 months at the latest after the results of the event on which the Customers played is known. Otherwise, complaints shall be considered ineligible. betFIRST will endeavor to provide the Customers with a final answer or solution in a timely manner.

13.4 Unresolved claim. Any dispute concerning a transaction carried out in connection with a Bet which cannot be resolved by the Terms and Conditions, and for which no equitable solution has been found will be resolved in accordance with Belgian laws before the jurisdiction of Liège.

13.5 Dissatisfied Customers. If Customers are dissatisfied with the response to the problem, they may contact the Consumer Mediation Service (Ombudsman), North Gate II, Boulevard du Roi Albert II 8, bte 1, 1000 Brussels (contact@consumerombudsman.be). The Belgian Gaming Commission is the supervisory authority and can take care of key claims (https://gamingcommission.be/en/contact/problems-with-a-gambling-operator).

13.6 betFIRST rights. betFIRST, at its sole discretion, reserves its rights to act against any person suspected of illicit actions or of intending to violate our Terms and Conditions.

13.7 GDPR requests. In case of GDPR request, betFIRST will follow the GDPR rules and the request for personal data shall be answered within 30 days, and if the request is complex, betFIRST will inform the Customers thereof and it may take up to 2 additional months to revert to the Customers.
